Fines of up to €750 for concealing job vacancies

The Estatuto de los Trabajadores obliges employers to inform employees about any job openings within the company. This requirement is set out in Article 6.5 of the LISOS law (Ley sobre Infracciones y Sanciones en el Orden Social) and aims to reduce temporary employment and promote more stable contracts.

Employers must notify:

  • Part-time workers (about opportunities to switch to full-time);
  • Employees with temporary contracts (about conversion to permanent positions);
  • Workers with intermittent contracts (fijos-discontinuos);
  • Remote employees (to ensure equal treatment with office staff).

Fines:

  • €70–150 for minor violations,
  • €151–370 for medium violations,
  • €371–750 for serious violations.

Companies are free to choose the communication channel: vacancies can be announced through the corporate intranet, email, physical notice boards, or other methods established in the collective agreement.
